PRIVACY POLICY

At mktg.ai (“we,” “us,” or “our”), we respect your privacy.  This Privacy Policy governs the ways we collect, use, and share information relating to you (“Personal Information”) in the course of our business, including when:

  • You visit our website at mktg.ai (the “Site”), our separate app.mktg.ai (“Application”), or other websites and apps we may release from time to time.

  • You communicate with us electronically, such as by email.

  • You interact with us offline, including in person, at an event or by phone.

  • We collect your information from third parties, such as through customer referrals.

  • We collect your information in any other context in which we link to or otherwise provide you with a copy of this Privacy Policy. 

We may change our Privacy Policy from time to time. Where we make material changes to this Privacy Policy, we will take steps to notify you of those changes by, for example, posting notice on the Site and Application or emailing you using the contact information we have on file. You can determine when this Privacy Policy was last reviewed or revised by referring to the “Effective Date” provided at the top of this page.

 

NOTE ABOUT ​CUSTOMER DATA

This Privacy Policy only applies to Personal Information we collect for our own business purposes. It does not apply to Personal Information we collect on behalf of our customers.

In providing the Application and other services to our customers, we may collect Personal Information on behalf of these customers for processing in the performance of our services. When this happens, we process your Personal Information pursuant to the contract with our customer, and their privacy policy applies to your Personal Information, not ours.

 

PERSONAL INFORMATION WE COLLECT

The Personal Information we collect includes information that can be used to identify or contact you, including without limitation your name, phone number, mailing address, and email address. We may also collect related information such as your interests, feedback, requests, and any other information you may provide about yourself in your communications and interactions with us. 

 

AUTOMATED DATA COLLECTION TECHNOLOGIES

We collect and store Personal Information that is generated automatically as you engage with us online. For example, we may collect information about your computer’s connection to the Internet, which allows us, among other things, to improve the delivery of our web pages to you and to measure traffic on the Site and Application. We also may use a standard feature found in browser software called a “cookie” to enhance your experience. Cookies are small files that your web browser places on your hard drive for record-keeping purposes. By showing how and when visitors use our services, cookies help us deliver advertisements, identify how many unique users visit us, and track user trends and patterns. They also prevent you from having to re-enter your preferences on certain areas of the Site where you may have entered preference information before. We may also use web beacons (single-pixel graphic files also known as “transparent GIFs”) to access cookies and to count users who visit the Site or open HTML-formatted email messages.

 

HOW WE USE YOUR PERSONAL INFORMATION

  • To provide the Site, Application, and other services to you, including providing technical and other support for these services.

  • In connection with our marketing activities, including to tailor advertisements and campaigns to you based on your interests.

  • To perform legal compliance activities, including to enforce our Terms of Service, to address fraud and other illegal activities, including claims of copyright infringement, to exercise and defend legal claims, and to protect your safety and the safety of other users of the Services.

  • To provide the information to service providers and other third parties as described in the “Sharing Your Personal Information” section below.

  • For other purposes consistent with the context of the collection of your information, or as otherwise disclosed to you prior to the use of your information.

  • As you may agree or consent from time to time.

 

SHARING YOUR PERSONAL INFORMATION

We may share your Personal Information with various parties, including:

  • Our contracted service providers that process Personal Information on our behalf for IT and system administration, credit card processing, research and analytics, marketing, consulting, accounting, customer support, data enrichment, and other purposes. This may include third-party AI platforms such as Google Vertex AI and OpenAI GPT-4 to optimize your experience, including image and video classification for refined search, semantic and similarity queries, and content search. Consistent with this Privacy Policy, we require that our contracted service providers limit their use of your Personal Information to purposes reasonably necessary for their provision of services to us.

  • Any current or future corporate affiliates, including as a result of any merger, acquisition, or other corporate transaction. 

  • With governmental authorities or other parties when we believe release is appropriate to comply with law or to protect the rights, property or safety of us, our users or the public.

  • As otherwise disclosed to you prior to the sharing of your information, with your consent or as consistent with applicable law.  â€‹

 

YOUR RIGHTS

Depending on where you reside and subject to any applicable exemptions or limitations, you may have the right to access, correct, delete, or withdraw consent with respect to your Personal Information.

If you wish to make a request to exercise your rights with respect your Personal Information, please email us at privacypolicy@mktg.ai with the full details of your request. Where applicable, we may need to ask you for additional details to verify your identity for purposes of responding to your request.

 

HOW WE RESPOND TO DO NOT TRACK SIGNALS

Some web browsers incorporate a "Do Not Track" ("DNT") feature that signals to websites that a user does not want to have their online activity tracked. Not all browsers offer a DNT option and DNT signals are not yet uniform. For this reason, many companies, including mktg.ai, do not recognize or respond to DNT signals.

 

GOOGLE DATA COLLECTION AND USE OF YOUR INFORMATION

In providing the Application and utilizing Google’s API services, we are committed to complying with Google's Limited Use Policy. Any data obtained in this manner from Google user accounts, including but not limited to information gathered through Restricted and Sensitive Scopes, will be used and transferred in accordance with Google's API Services User Data Policy, including the Limited Use requirements. Google Workspace APIs are not used to develop, improve, or train generalized AI or machine learning models. For more details, please refer to Google's API Services User Data Policy here. Regarding our Application, Google user data is used to provide or improve the Application’s functionality.

THIRD-PARTY LINKS

Our Site, Application and other services may include links to other web sites and provide access to products and services offered by third parties, whose privacy policies we do not control. The appearance of any third-party links on the Site or Application does not indicate any endorsement or sponsorship by us of the goods or services available on those third-party sites or the owners or operators of such sites. When you access another web site, use of any information you provide is governed by the privacy policy of the operator of the site you are visiting or the provider of such products or services. You should read the privacy policy governing any third-party site that you visit.

 

CHILDREN’S PRIVACY

Our online services are not directed to children under the age of thirteen and we do not knowingly collect personal information from children under the age of thirteen. If we become aware that we have received personal information from a child under the age of thirteen online, we will delete such information from our records. If we change our practices in the future, we will obtain prior, verifiable parental consent before collecting any personal information from children under the age of thirteen.

 

INFORMATION RETENTION

We may retain your Personal Information as reasonably necessary for the purposes described in the “How We Use Your Personal Information” section of this Privacy Policy.  In determining when your Personal Information is retained or disposed, we may consider the nature and sensitivity of your Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we process your Personal Information, and applicable legal requirements.

 

SECURITY

We employ certain physical, administrative, and technical measures in an attempt to protect your Personal Information. Although we do attempt to keep your Personal Information secure, we cannot guarantee the security of your Personal Information. Your communications with us are subject to all of the risks associated with the Internet, including without limitation unauthorized access and use.
